New Delhi: Former Supreme Court judge Justice Sanjay Kishan Kaul recently revealed that former Chief Justice of India DY Chandrachud was deferential to the government and often sought government’s pre-approval before collegium discussed names for judicial appointment.

In an interview, Justice Kaul said that it had become an unfortunately a practice of names being discussed, and some kind of previous discussion with the Government. “That used to happen. It has been happening, I think, before [CJI Chandrachud] and after. That is why it troubles me,” Justice Kaul said.

Justice Kaul also disclosed that the case concerning delays in judicial appointments was withdrawn from his bench when he was attempting to push the Union Government to act on pending collegium recommendations, adding that the then CJI appeared to have been under some pressure to remove the matter from his bench.

Pointing out the pressure the judges worked under the BJP government, Congress on Sunday raised concerns over the independence of the judiciary. The party stressed that an institution entrusted with upholding the Constitution must remain free from the influence and pressure of those in power.
