Article 370 Is A Temporary Provision: CJI Chandrachud

The Supreme Court is pronouncing its judgment today, November 11, on a batch of petitions challenging the abrogation of Article 370 of the Constitution, which granted special privileges to Jammu and Kashmir. A five-judge Constitution bench, headed by Chief Justice DY Chandrachud, is all set to deliver the historic verdict. Apart from Chief Justice DY Chandrachud, the other key members of the Constitution bench are Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant.

Chief Justice DY Chandrachud, while delivering the historic Article 370 verdict, stated that the said Article in Jammu and Kashmir was a temporary provision.

Justice Sanjay Kaul invokes the “people of Kashmir”. He said his conclusion on the issue are almost as same as the Chief Justice of India (CJI). He recommended Constitution to be the committee of impartial truth and Reconciliation. Justice Khanna opined Article 370 is an asymmetric federalism and not an indicative of sovereignty over Jammu & Kashmir. Abrogation of Article 370 does not erode federalism, he added.

Meanwhile, Omar Abdulla, Vice President of JKNC (Jammu Kashmir National Conference) take a dig at Gulam Nabi Azad, up on his call of abrogation of Article 370 a “mistake”.

 

The Supreme Court also orders the Jammu& Kashmir State Assembly to be held before September 30 and added that the restoration of statehood of Jammu & Kashmir should be expedited.
