Exclusive: Deportation Notice To Pakistan Withdrawn For Kozhikode Resident Hamsa

Kozhikode, Kerala: The deportation notice issued to 77-year-old Quilandy resident Hamsa, who holds Pakistani citizenship, has been withdrawn following high-level directives, a close relative told Timeline.

The official notice, which had demanded that the 3 individuals, including Hamsa, leave the country by April 27 due to an alleged lack of valid documents, was sent out earlier this week. However, in a significant relief to the family involved, authorities have now decided to retract the order.

A close relative of Hamsa confirmed to Timeline that the police have officially informed them of the withdrawal of the notice.

The relative, while expressing gratitude for the decision, srated that he is under immense mental stress due to the media coverage. “He becomes very upset seeing himself in the news,” the family member told Timeline.

Hamsa, who has been living in Quilandy, reportedly suffers from heart conditions and other age-related health issues.

The relative mentioned that while the news of the deportation notice withdrawal brought relief and happiness, Hamsa is still facing stress and difficulties due to the constant calls and inquiries.

The family emphasised that he was born in Kerala and had moved to Pakistan for work before the partition of Bangladesh, after which he obtained a Pakistani passport. During the Emergency period in India, he returned and has since been residing in the country on a temporary visa.

The family also stated that Hamsa has repeatedly applied for Indian citizenship since 2007 but has yet to receive official documentation.

They added that the Pakistani passport once held by Hamsa was taken by police, and he currently possesses no passport, nor does he have any support system in Pakistan.

Initially, the notice, addressed to Hamsa and two others from Vadakara, had warned of legal consequences if they failed to leave India by April 27. It cited the absence of sufficient legal documentation for their stay in the country.

Following the backlash and intervention at higher levels, the Kozhikode police reportedly decided to withdraw the notices on Saturday morning, providing a significant reprieve to the elderly individual and his family.

The family of Hamsa has also indicated their intention to approach the Kerala High Court and has submitted a formal petition to the Chief Minister along with supporting documents.

The withdrawal of the notice comes as a relief for the affected families, but the relative informed Timeline that they continue to seek a permanent resolution regarding citizenship and legal status, emphasising Hamsa’s long-standing ties to India and deteriorating health condition.
