The Bharatiya Janata Party (BJP) had recently written to the Election Commission of the nation requesting an immediate suspension of the Congress leader Rahul Gandhi’s official X (formerly Twitter) account. The ruling political party at India’s centre under the incumbent Prime Minister Narendra Modi, send a letter to the top poll-body on Saturday, over a tweet by Rahul Gandhi, which the BJP termed as having “offending contents”.

The BJP in their request, argued for the immediate suspension of Rahul Gandhi’s X account and the removal of the “offending comments with immediate effect”. They have also requested the Commission to issue directions to the the Chief Election Officer of Rajasthan for filing a criminal complaint and initiating criminal prosecution against Rahul Gandhi.

Rajasthan went polling booths on Saturday, November 25, and the people is electing 200 representatives for their legislative assembly. The result of the election, as per the Election Commission of India, is scheduled to be declared on December 3, 2023.

The comment that went controversial was also posted on the same day, Saturday, while Rajasthan was getting ready to went casting their votes. The post reads “Rajasthan will choose free treatment, Rajasthan will choose cheaper gas cylinder, Rajasthan will choose interest free agricultural loan, Rajasthan will choose English education, Rajasthan will choose OPS, Rajasthan will choose caste census”. “Today, go out in large numbers and exercise your franchise. Elect a Congress government that is beneficial to the people and has guarantees”, Rahul Gandhi added.

According to BJP, the post violated the silence period of 48 hours during which any type of campaign is barred: “posting such a message on the date of polling… amounts to committing an offence under section 126 Representation of People act 1951 which inter alia prohibits displaying any election matter by means inter alia, of television or similar apparatus, during the period of 48 hours before the hour fixed for conclusion of poll in a constituency”.
