'Jail Until Death Bigger Punishment’: Madras High Court Commutes Death Penalty Of Man Who Raped Daughter

Madras High Court recently reduced the death sentence of a man who rapped his daughter. The court instead sentenced the man to imprisonment for life.

While hearing the case, a division bench of Justice N Anand Venkatesh and Justice K Ramakrishna observed that life in prison is bigger punishment for the convict in the case, reported Bar and Bench.

“Life imprisonment until death is a more enduring retributive measure than the finality of the gallows,” the Court said, adding that keeping the convict alive to face a lifelong dialogue with his own conscience serves the ends of justice better than execution.

The court said the convict, Murugan, is already living in a state of stark isolation, having been completely abandoned by his family and community. The court hence sentenced the convict to imprisonment for the rest of his life. The court clarified that the convict shall not be eligible for premature release, remission or further commutation.

The convict should remain incarcerated until his death, the court ruled.
