Narcotics Case: Madras HC Imposes Rs10 Lakh Penalty On Police For Fabricating Evidences
Chennai, Tamil Nadu: Madras High Court recently passed an order imposing a Rs 10 lakh penalty on three police officers for fabricating evidence and giving false testimony. The ruling was in connection with a narcotics case.
While hearing the case, Justice KK Ramakrishnan noted that it was proved that the officers conspired to secure a wrongful conviction under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, the Bar and Bench reported.

The Court also acquitted the man arrested by police and convicted by a special court recently. The man was falsely alleged to have possessed 24 kilograms of ganja, and was sentenced to ten years’ rigorous imprisonment and fined Rs 1 lakh by the lower court.
However, the High Court found that the prosecution story was false and unsupported by credible evidence, noting that the police conspired together to get the conviction by hook or crook by giving false evidence before the trial court.

The entire case rested on fabricated documents and contradictions in the testimonies of the investigating officers, the court pointed out. The court further observed that such conduct amounted to a serious violation of the accused’s fundamental right to a fair investigation and trial.
The Court also ordered the Director General of Police, Chennai to initiate disciplinary proceedings against the officers, while asking the police chief to complete the inquiry within one month.
