Pushkar Singh Dhami-led Uttarakhand government on Monday approved tough anti-riot law (ordinance) in which the offenders to pay the entire cost of the damage incurred during riots. It was after the recent implementation of strictest anti-copying law, and Uniform Civil Code (UCC) Bill, the Uttarakhand Cabinet has passed
the Uttarakhand Public (Government) and Recovery of Damage to Private Property (Ordinance) Act 2024.

As per this new ordinance, the government ensures that the complete recovery of damages to private and government property will be initiated from the rioters. Besides, if someone”s body is mutilated during the riot, the total cost of treatment will be recovered from the rioter. Aside from that, a fine of up to Rs 8 lakh is imposed on the offenders and also they will be held accountable for covering the expenses suffered by the government staff for riot control measures.

The Cabinet has also sanctioned setting up a formal Claims Tribunal in order to take stringent action against the rioters. Through the assistance of the Tribunal, the recovery will be initiated from the rioters and their family members as well as their property. An Additional District Magistrate (ADM) category officer will be in charge as the Claims Commissioner. The government adds that the Claims Tribunal will also comprise members other than the retired judge.

Expressing observation on the law, the Chief Minister said: “Those who disrupt peace in the state will now have to bear the consequences,” Times of India reports.

The law is waiting for Governor”s approval. Using the powers conferred by Clause 1 of Article 213 of the Constitution of India, the Governor has the authority to implement this law in the state.
