TCS Forcing Sudden Transfers: Alleges NITES, Files Complaint

Tata Consultancy Services (TCS), one of the prominent name in IT services and consultancy, is forcibly transferring its employees, alleges The Nascent Information Technology Employees Senate (NITES). NITES is an IT sector employee rights organisation, and they have lodged formal complaint against TCS in this regard with the Ministry of Labour and Employment.

The employee rights organisation accuses that TCS has instigated the transfer of over 2,000 employees across locations without even consulting with the affected party. They are given two weeks notice period to move to the new location.

“We believe that TCS’s actions are unethical and in violation of labor laws. The company has not provided a valid reason for the transfers, and it has not given employees a fair opportunity to provide alternative solutions,” ET quotes as said in the complaint.

A month before, TCS has ordered employees to work from office five days a week. This new sudden transfer notice is second in this regard. The emails mention that their relocation is necessary pertaining to business requirements and no other details were given. The employees began to receive emails from the end of August, and according to the emails, reimbursements on travel and accommodation will be provided later.

The forceful transfers created financial and emotional stress among the employees, NITES reports. The organisation, therefore, requested the labour ministry to enquire TCS” transfer practices and consider prompt action if any unethical factors violating labour laws were found. A TCS senior executive without revealing the name told ET that it is a “routine activity.”

“Normally company-initiated transfers are an outcome of a specific business requirement from clients. However, we have received complaints from employees stating that they have been transferred without any client project at hand,” ET quotes as Harpreet Saluja, president of NITES as saying. The president, adding further, says that most of the employees who were demanded of this transfer are in 1-2 year experience category and majority are coming from Hyderabad base location.
