"Your Choice To Watch Or Not": Calcutta HC Refuses To Stay "The Diary Of West Bengal" Release

The Calcutta High Court today dismissed a plea to stay the release of “The Diary of West Bengal,” a film under scrutiny for its alleged communal undertones. The movie, which focuses on events related to the 1971 Bangladesh Liberation War, is scheduled for release on August 30.

A division bench of Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya, refused to grant the urgent relief sought by the petitioners. “Courts have repeatedly held that if you want watch the movie, watch it, if you don’t then don’t. We are in a democratic setup. Any healthy criticism is welcome. If those who are aggrieved come, then let them approach us. West Bengal is a tolerant society…Where are we headed, if you want we will admit it and keep it pending…” the bench said according to LiveLaw.

The petitioners had argued that the film’s content, which they claimed is communal in nature, could incite unrest given the current volatile climate. They sought to delay the film’s release to prevent potential disturbances.

Despite these concerns, the Court ruled that such a PIL could not be used to halt the film’s release and allowed it to proceed as planned.

“The Diary of West Bengal,” featuring Arshin Mehta, Gauri Shankar, and Yajur Marwah in lead roles is set amid the crisis faced by Rohingya refugees from Myanmar and illegal infiltrators from Bangladesh. The film aims to portray life in West Bengal against this backdrop and address modern-day challenges. It also touches on the contentious issue of “love jihad”, a term used to describe Hindu-Muslim relationships by the right wing.

Director Sanoj Mishra described the film as “a personal journey into Bengal’s soul, capturing its historical essence and contemporary issues. It’s a homage to the untold stories of its people, offering a fresh perspective on their collective spirit.”

The film’s trailer had sparked a substantial controversy, leading to allegations that it defames West Bengal. Mishra, who has directed films like “Ram ki Janmabhoomi” and “Gandhigiri”, alleged threats to his life.
