Two day long public hearing of South Africa’s genocide case against Israel will start today, January 11. All eyes are on International Court of Justice, based in Hague, Netherland. Several countries welcomed South Africa’s move seeking to stop brutal and genocidal military assault which claimed lives of 23,000 Palestinians, among which over 10,000 were children.

South Africa accused Netanyahu government of committing genocide on Gaza and said that it violated the 1948 Genocide Convention, which was issued during the aftermath of World War II and the Holocaust. Since both Israel and South Africa are the signatories of the United Nations Genocide Convention, it gives ICJ jurisdiction to rule on disputes over the treaty.

Every state that has signed the convention are impelled to not to commit genocide and also to prevent and punish. The treaty describe genocide as “acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group.

As hopes of passing a ceasefire resolution in the UN Security Council continue to prove as a lost cause with America flaunting its veto power every time, South Africa decided to move to the International Court of Justice. As the hearing nears, several countries voiced their support for South Africa. The 57 members bloc, The Organization of Islamic Countries, which also include Saudi Arabia, Iran, Pakistan, and Morocco, pronounced their support for the case last month.

In a statement released on January 2, Malaysia, a strong supporter of Palestinian cause has reiterated the call for an independent Palestinian state based on pre-1967 border, with East Jerusalem as its capital.

Spokesperson of Ministry of Foreign Affairs of Turkey, Oncu Keceli posted on X (formerly twitter) welcoming South Africa’s move. He said, “It is expected that within the framework of this application, the International Court of Justice will decide on provisional measures involving those to stop Israel”s attacks on Gaza. Türkiye will also follow the implementation of this decision”.

 

Jordan’s Foreign Minister Ayman Safadi also joined the list of countries that joined South Africa ““to stop the aggression and protect our people in Palestine and to expose the inhumane and illegal Israeli practices that have reached the point of war crimes in the Gaza Strip.”

 

Bolivia became the first Latin American country to support South Africa in the case and dubbed the country’s move as historic. Bolivia has earlier submitted a request in the International Criminal Court (ICC).

 

Maldives and Pakistan also joined to show their support for South Africa during a UN General Assembly session which was held on Tuesday. Other countries that support the Genocide Convention lawsuit are, Nicaragua, Venezuela, Namibia, Bangladesh, and Saudi Arabia.

The latest country to voice their support for South Africa was Columbia. The country’s President Gustavo Petro shared the press released by the Columbia’s Foreign Ministry that called South Africa’s move as a “brave step in the right direction”. The press released also read that “it is very clear that the actions and measures adopted by the government of Israel constitute acts of genocide”.
