The International Court of Justice (ICJ) issued a press release confirming the public hearing of the proceeding instituted by South Africa against Israel on December 29, 2023. The hearing will take place at the ICJ court in Peace Palace in The Hague. ICJ said the hearing will be dedicated to South Africa’s request for “provisional measures”. The hearing will take place on January 11 and 12.

South Africa will make its oral argument on Thursday, January 11 from 10 am to 12 pm, and Israel, who has promised to face South Africa’s accusation, will make their oral argument on Friday, January 12, from 10 am to 12 pm.

South Africa requested “provisional measures” to protect against the “severe and irreparable harm to rights of Palestinian people under the Genocide Convention”, and to punish and prevent Israeli genocide of the Palestinians.

Drawing attention to the alleged violations by Israel of its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide (the “Genocide Convention”) of  Palestinians in the Gaza Strip, South Africa filed an application asking proceedings against Israel before the International Court of Justice (ICJ), the principal judicial organ of the United Nations.

South Africa said that since October 7th, Israel has “failed to prevent genocide and has failed to prosecute the direct and public incitement to genocide” and that “Israel has engaged in, is engaging in and risks further engaging in genocidal acts against the Palestinian people in Gaza”.

Israel called South Africa’s application to the ICJ is a ‘blood libel’ that has ‘no factual and judicial basis and is a despicable and cheap exploitation of the court’. The occupation state has also said that South Africa is ‘collaborating with a terror group that calls for the destruction of the State of Israel’.
