Evidence Clearly Establishes Dileep Gave ‘Quotation’ To Assault Actor, Kerala Govt Tells High Court

The Kerala government has told the Kerala High Court that evidence on record clearly establishes that actor Dileep gave the “quotation” to sexually assault the survivor in the 2017 Malayalam actor abduction and assault case, despite his earlier acquittal by the trial court.

In its appeal challenging the Sessions Court verdict, the state has sought to overturn the acquittal of Dileep and three others, Charly Thomas, Sanilkumar alias Mesthiri Sanil, and Sarath G Nair.

The government has also requested enhancement of the sentence awarded to the six convicted accused, including Sunil N S, who was found guilty in the case.

The prosecution described Dileep as the “master conspirator” and argued that the trial court adopted a flawed approach while assessing the evidence against him.

According to the state, the Sessions Court examined pieces of evidence in isolation instead of viewing them as part of a larger chain of conspiracy. It contended that legally admissible and reliable evidence was rejected arbitrarily, leading to Dileep’s acquittal.

The appeal further stated that the trial court focused mainly on the execution of the crime by Accused 1 to 6, while overlooking the alleged primary conspiracy between Dileep and Pulsar Suni.

The prosecution maintained that all the accused were part of a single conspiracy and are legally responsible for the acts committed in furtherance of that plan.

Additionally, the state termed the punishment given to the convicted accused as “highly disproportionate and inadequate,” arguing that only the minimum sentence was imposed for the principal offence of gang rape.

The government has now sought maximum punishment for the convicted and a conviction for those acquitted, as the High Court prepares to examine the appeal.
