
Rajasthan HC Ups Compensation For Paralysed Road-Accident Victim To Rs 1.9 Crore From 1.4 Crore
Rajasthan High Court recently raised the compensation of a paralysed road-accident victim from Rs 1,49,88,153 crores awarded by a motor accident tribunal to Rs. 1,90,68,153 crores. While enhancing the compensation to the 21-year-old woman victim, the high court ruled that the 100% lower body paralysis of the road-accident victim was not just an injury, but a deep, enduring rupture in the fabric of her life.
The court pointed out the paralysis affected her sense of identity, independence and confidence. While hearing the case, a bench of Justice Ganesh Ram Meena observed that any support or compensation received by her, whether from the legal system or society at large, was not a favor, underlining that it is an essential decision towards justice, human dignity and inclusion.

The bench then opined that it is also to be acknowledged that the accident caused not just the cost of medical case but the loss of opportunities, dignity and dreams, adding that the incident caused trouble for her to start family life, creating a heavy burden for her family and loved ones.
“Enhanced compensation is not a windfall; it is a moral and legal necessity. It is an attempt by the justice system to at least partially restore what was taken from her future: a body, a chance to live on her own terms. “Anything less would be an injustice too great to ignore,” the court pointed out.

The victim, the 21-year-old woman was a student at National Institute of Technology, Uttarakhand, when she was hit by a vehicle owing to rash and negligent driving by the driver resulting in 100% paralysis of her body below the waist.
A tribunal court earlier awarded her around Rs. 1.5 Crores as compensation, and then she challenged the compensation for being being inadequate.
