While hearing the Delhi chief minister and AAP chief Arvind Kejriwal’s plea challenging the Delhi High Court’s interim stay on his bail order, the Supreme Court today opted to hear the case on June 26. The apex Court observed that  issuing a verdict at present would amount to prejudging the issue, as the High Court is likely to pronounce its order tomorrow.

After being granted bail from Delhi’s Rouse Avenue court on June 20 in the money laundering case in connection with the liquor policy, the Delhi High Court on June 21 halted the release order till it reviews the case after the ED moved the high court against the lower court’s bail order. However, the AAP supreme had approached the Supreme Court on Sunday, challenging the high court’s interim stay on his bail order.

However, the top court has chosen to wait for the High Court’s order in the case, with no immediate relief for the chief minister. While hearing the petition, the Supreme Court also noted the “unusual” nature of the Delhi High Court’s interim stay on Kejriwal’s bail order passed by the district court while reserving its final decision on the ED’s stay application.

Talking about the case, Kejriwal’s counsel advocate, Rishikesh Kumar said, “Today we have challenged the order of the High Court granting stay on the bail of Arvind Kejriwal. The matter was mentioned and it was listed today for the hearing. The court has said today that because the final order of the High Court has still not come and it is likely to be pronounced tomorrow. So the matter has been adjourned for the day after tomorrow,” Times of India reports.

The chief minister’s counsel had argued that the High Court’s order was unlawful, seeking the implementation of the lower court’s bail order. However, the apex court, after the potential high court order tomorrow, will hear the petition on Wednesday.

The AAP supremo was arrested by the ED in March this year in the case. He was granted interim bail during the Lok Sabha election campaigns. Kejriwal returned to Tihar jail after his bail expired on June 2. However, he has been given no immediate relief from the top court.
