Terms and conditions of Disney+ during a free trial of the streaming service prevent a man from suing the company after his wife died suffering an allergic reaction on the heels of eating at Disney World resort in Florida. Jeffrey Piccolo had filed a “wrongful death” lawsuit against the company after his wife Kanokporn Tangsuan’s death last year.

The man claimed his wife, a doctor from New York died after an allergic reaction from her meal at the company’s resort. He alleged that his wife had a severe allergy to dairy and nuts and they asked the waiter several times about the ingredients of the meal they ordered, but the waiter assured them that their food would be allergen-free. After taking the food, his wife had a severe reaction and died the same day.

The autopsy of the woman also revealed that the cause of death was the chemicals with the potential to shock the body due to the increased level of dairy and nuts. The lawsuit thus stated that the misfortune happened due to the negligence of the waiter and demanded over $50,000 as  compensation. However, Disney wanted to dismiss the case and settle it out of court, noting that the users had agreed to resolve the dispute through arbitration without court interference.

The company also noted that when a person creates a Disney+ or ESPN+ account, he agrees to the Walt Disney Company’s Terms of Use, which govern your use of other Disney Services. It also included the clause regarding the disputes and settlements involving the company and its affiliates.
