
SC-Monitored Election Reverses EVM Result Of Haryana Panchayat Sarpanch: Report
Panipat, Haryana: Amid the political chaos around the alleged vote theft, an Electronic Voting Machine (EVM) result of a Haryana Panchayat election was overturned on a Supreme Court order. The court overturned the election result of the Sarpanch of Gram Panchayat Buana Lakhu in Haryana’s Panipat district. The move followed the court-monitored EVM recount, which found the appellant, Mohit Kumar, securing the highest number of votes. The earlier result, which was in favor of the sitting Sarpanch, was negated following the court-monitored poll outcome, The Tribune reported.
The election for the Sarpanch’s post was held on November 2, 2022, and the respondent, Kuldeep Singh, was declared elected. Notably, Mohit Kumar challenged the result before the Additional Civil Judge (Senior Division)- cum-Election Tribunal. Though the tribunal found grounds for recounting the votes at a booth, the Punjab and Haryana High Court overturned that decision, forcing Mohit Kumar to approach the apex court.

However, in a first-of-its-kind exercise, a bench of Justices Surya Kant, Dipankar Datta, and N.K. Singh ordered the recounting undertaken under the supervision of SC OSD (Registrar) Kaveri in the presence of both parties and their advocates and the entire exercise was video-graphed. The court summoned Electronic Voting Machines (EVMs) and other records of the election of the sarpanch of the gram panchayat of Buana Lakhu village, Panipat, Haryana, and held a recounting of votes, leading to the shocking reversal of the poll result.
The court then went to direct the Deputy Commissioner-cum-Election Officer to issue a notification in this regard within two days declaring the appellant (Mohit Kumar) as the elected Sarpanch of the above-mentioned gram panchayat. The court said Mohit Kumar shall be entitled to assume the said office (of sarpanch) forthwith and perform his duties.

The development assumes significant importance amid rising concerns over the electoral system, especially following the explosive revelation made by Congress leader Rahul Gandhi about the alleged irregularities in the 2024 Lok Sabha elections.
Sharing the report regarding the reversal of result, author and columnist, Devinder Sharma, wrote, “It only shows how people have to be doubly alert to save democracy.”
