A transgender teacher whose services have been terminated by two private schools due to her sexual orientation has appealed before the Supreme Court on Tuesday. Her services have been ended by schools in Gujarat and Uttar Pradesh when her sexual orientation were known to the employers.
Hearing the plea of the transgender woman, a bench comprising Chief Justice D Y Chandrachud and justices J B Pardiwla and Manoj Misra said, “We will see what we can do”. Following, the top court sent notices to the Centre, Gujarat and Uttar Pradesh governments. Additionally, the bench has also invited responses from head of the school in Jamnagar in Gujarat and the chairperson of another private school based at Khiri in Uttar Pradesh.
“The grievance of the petitioner is that her services were terminated in schools of Uttar Pradesh and Gujarat after her gender identity was revealed. The petitioner says that she cannot pursue her remedies in two different high courts,” PTI reports as the apex court is saying. The bench then allotted the plea to be heard after four weeks.
The counsel appearing for the transgender teacher reported that she has given a letter of appointment in an Uttar Pradesh school and has taught for six days before she was sacked. She was given the letter of appointment in Gujarat school, and then denied the possibility to join after her sexual identity was known, the counsel added.
The petitioner asks for the implementation of her fundamental rights, the lawyer said.
