'Must Show Sensitivity In Matrimonial Cases, Not Just Apply Law Strictly': Delhi High Court Chief Justice
Chandigarh: Delhi High Court Chief Justice Devendra Kumar Upadhyaya says that the judges and lawyers must show sensitivity in matrimonial cases rather than just adhering to the law strictly. He was speaking on the second day of India International Disputes Week 2026 in Chandigarh on Sunday delivering a keynote address.
‘Justice in matrimonial dispute cases cannot always be delivered by strictly adhering to the law, the high court chief justice emphasised, highlighting that lawyers representing the parties as well as the judges have to be a bit sensitive in such matters.

The search for justice does not always end within the four corners of law, the judge pointed out, adding that it is more of a social problem than a legal one. Judge further commented on the cross-border matrimonial disputes, especially the child custody cases, observing that the domestic laws in India are not sufficient.
“Despite a recommendation made by the Law Commission of India, we are yet not signatories of certain international treaties. There is a growing urge and demand from all parties for India to be signatory of the international conventions,” justice DK Upadhyaya added, lamenting that the task for the domestic courts becomes very difficult in the absence of such a system.
